Naturalization is the process through which a foreign-born person can become a United States citizen. Since 2010, my firm has been helping clients understand their eligibility with respect to citizenship and guiding them through the application process. To apply, you must be at least 18 years old and be one of the following:

  • a legal permanent resident of the United States for at least five years
  • a grantee of political asylum for at least four years
  • a legal permanent resident of the United States for at least three years who has served in the U.S. military
  • a legal permanent resident of the U.S. for at least three years and the spouse of a U.S. citizen

Applicants must demonstrate that they have been physically present in the United States for at least half of the required periods and:

  • can speak, read and write English
  • have a basic understanding of U.S. government and history
  • subscribe to the ideals and principles of the U.S. Constitution
  • are of good moral character

Government examiners will administer written and oral tests to determine eligibility as well as conduct background checks.

Even if you weren’t born in the United States, you may have the opportunity to establish birthright citizenship by fulfilling the requirements of being a “natural-born” U.S. citizen. Title 8 U.S. Code § 1401 establishes several circumstances in which a child born outside the U.S. could be considered a “citizen at birth.” These include, among others:

  • Anyone born outside the United States, where both parents are U.S. citizens and at least one parent has lived in the United States
  • Anyone born outside the United States, where one parent is a U.S. citizen who has lived in this country for at least one year and the other parent is a U.S. national
  • Anyone born in a U.S. possession where at least one parent is a U.S. citizen and has lived in the United States for a minimum of one year
